RecallTutor ("RecallTutor", "we", "us") operates the website https://recalltutor.com and provides an AI-assisted active-recall learning service (the "Service"). These Terms of Service ("Terms") govern your access to and use of the Service.

By creating an account, subscribing to a plan, or otherwise using the Service, you represent that: (a) you are at least 18 years old or the age of legal majority in your jurisdiction; (b) you have read, understood, and agree to be bound by these Terms; (c) you agree to our Privacy Policy; and (d) you have the authority to enter into this agreement.

Important: if you do not agree to these Terms, do not use the Service. Continued use after an update to these Terms constitutes acceptance of the revised Terms.

1. Acceptance of Terms

These Terms form a binding agreement between you and us. By using the Service you accept all of their provisions; otherwise you must stop using the Service.

2. Description of the Service

2.1 What we provide

RecallTutor is an AI-powered learning platform. You provide study material (or a learning goal), and the Service generates a structured course and tutors you through it using guided questions and mastery checks. The Service is a digital software-as-a-service (SaaS) product delivered over the internet.

2.2 Nature of the Service

The Service is an intangible digital product. Access is enabled immediately after payment is confirmed. Because of the immediate nature of digital delivery, refunds are subject to the specific limitations in Section 7.

2.3 Dependence on third-party AI models

The Service relies on third-party AI model providers. Performance and availability may be affected by the operating status of those providers. Material outages will be communicated to users where feasible.

3. Accounts

3.1 Creating an account

The Service requires an account created with a valid email address verified through a one-time code, and a password. You are responsible for keeping your credentials confidential and for all activity under your account.

3.2 Account security

• Contact us immediately at [email protected] if you suspect unauthorized use.
• Do not share your login credentials with any third party.
• Keep your billing email address valid and accessible.

4. Plans and Quotas

We offer a free plan and paid monthly subscription plans. Each plan includes a monthly allowance of AI usage credits; paid plans include unlimited courses and full access to course content. Current plan details and pricing can be found in the pricing section on our homepage.

We reserve the right to modify plan features or introduce new plans at any time; if prices or plan contents change, users will be notified before the effective date.

5. Billing and Payment

5.1 Subscription auto-renewal

When you subscribe to a paid plan, you expressly authorize us to charge your chosen payment method the applicable fee on a recurring basis until you cancel under Section 6. Your subscription renews automatically at the end of each billing cycle unless cancelled.

5.2 Payment processing

Payments are processed by a third-party payment provider. We do not store your full card details. Prices are exclusive of applicable taxes unless stated otherwise; where required by law, applicable taxes will be collected.

6. Cancellation

You may cancel your subscription at any time from your account settings or by emailing [email protected]. Cancellation takes effect at the end of the current billing cycle; no further renewal charges will occur after that.

7. Refund Policy

The Service is a digital product. Once payment is completed, the Service is provisioned immediately, and refunds are generally not supported.

7.1 Eligible refund cases

• First-subscription 7-day guarantee: new subscribers may request a full refund within 7 days of the first charge, provided that usage (such as credits consumed) has not exceeded 30% of the plan quota.
• Duplicate charges: full refund when a billing system error results in duplicate charges.
• Unused quota: for separately purchased credit packs, the unused portion may be fully refunded within 7 days of purchase; consumed credits are non-refundable.
• Service outage: if the Service is continuously unavailable for more than 72 hours due to our fault, a pro-rata refund or compensation will be provided.

7.2 Refund process and timing

To request a refund, email [email protected] with your account email, transaction ID, and reason. We will confirm eligibility within 2 business days and return approved refunds via the original payment method within 5–10 business days after confirmation.

7.3 Non-refundable cases

• Subscription fees already used in the current period (except as listed in 7.1).
• Consumed credits.
• Fees related to accounts terminated for violating these Terms or the Acceptable Use Policy.

8. Billing Disputes

If you believe a charge is incorrect, contact [email protected] before initiating a chargeback with your bank. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.

9. AI Content and Intellectual Property

9.1 Output ownership

Subject to these Terms, AI-generated responses produced from your input ("Output") belong to you, and you may use them for any lawful purpose.

9.2 License to your input

You grant us a limited, non-exclusive license to process content you submit (uploaded documents, pasted text, learning goals, conversation messages — collectively "Input") solely to operate and provide the Service to you. We do not use your Input to train AI models without your explicit consent.

9.3 Third-party model dependence

Input is processed by third-party AI model providers to generate tutoring responses. We do not guarantee specific output quality and are not liable for content generated by third-party models.

9.4 Accuracy of AI output

AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying Output — especially for examinations or certifications — before relying on it.

10. Acceptable Use

10.1 Permitted use

You may use the Service for lawful personal learning and study purposes.

10.2 Prohibited use

You agree NOT to use the Service to:

• generate illegal, defamatory, harassing, or fraudulent content;
• create malware, phishing content, or attack tools;
• infringe intellectual property or privacy rights of any third party;
• bypass, scrape, or interfere with the Service's security features, quotas, or infrastructure;
• upload content you have no right to share, including copyrighted works you do not control;
• resell, sublicense, or provide automated API access to the Service without prior written consent.

We may suspend or terminate accounts that violate this Section, with notice where practicable.

11. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, our aggregate liability arising from or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

12. Changes to These Terms

We may update these Terms. For material changes affecting paying subscribers, we will give at least 14 days' notice by email or in-product notice before the effective date. Continued use after the effective date constitutes acceptance.
